What Is The Title Company's Role In Residential Transactions?

The Location Drawing

Where a lender is involved, it is customary for the Lender to require the title company to order a location drawing of the property to show the approximate location of the dwelling and other structures within the property boundaries. This facts revealed by the location drawing will help determine the following matters:

  1. Whether the facts revealed in the title examination and abstract are the same as shown on the location drawing;
  2. Whether the improvements within the property boundaries comply with zoning building set-back requirements;
  3. Whether any adjoining property owner is infringing the property being conveyed, i.e. a neighbors fence which encroaches the property;
  4. If requested, whether the property being conveyed is within a 100-year flood plain.

If a lender is not involved, a location drawing is not required, but is recommended.
